《工伤保险条例》第三十九条 工人因工丧命，其近亲属按照下列限定从工伤保险基金领取丧葬补贴金、供养亲属抚恤金和一次性工亡补贴金：

Article 39 of the Regulations on Work-related Injury Insurance: If a worker dies at work, his or her close relatives shall receive funeral allowance, dependant's pension and one-time work-related death allowance from the work-related injury insurance fund according to the following restrictions:

1、丧葬补贴金：为6个月的兼顾地区上年度工人月平均薪水。

1. Funeral allowance: the average monthly salary of workers in the region in the previous year for 6 months.

2、供养亲属抚恤金：按照工人本人薪水的肯定比例发给由因工丧命工人生前提供主要生活来源、无劳动本领的亲属。准则为：另一半每月40%，其他亲属每人每月30%，孤寡老人或者孤儿每人每月在上述准则的基础上增加10%。核定的各供养亲属的抚恤金之和不应高于因工丧命工人生前的薪水。供养亲属的具体范围由国务院社会保险行政部门限定。

2. Pension for dependent relatives: the pension shall be paid to the relatives who have no labor skills and who provided the main source of livelihood for the workers who died due to work according to the positive proportion of their own salary. The criteria are: the other half is 40% per month, the other relatives are 30% per month, and the elderly or orphans are increased by 10% per month on the basis of the above criteria. The sum of the approved pension of each dependant shall not be higher than the salary of the worker who died at work. The specific scope of supporting relatives shall be limited by the social insurance administrative department of the State Council.

3、一次性工亡补贴金：准则为上2年度全国城镇居民人均可支配收入的20倍。
