1、住宅小区的停车位是作为配套设施用房纳入小区规划，同时报建、同时施工、同时交付使用的，停车位与住宅小区的主体建筑具有密不可分的主从关系，相对主题建筑来说，具有一定的附属性和非独立性。因而，住宅小区内部的停车位不能脱离小区住宅房屋而单独买卖。

2、按照建设部住宅小区规划建设的有关规定，住宅小区市政公用基础设施和公用配套设施的配建水平，必须与居住人口规模相对应。在住宅区建设一定数量的车位，规划部门是有明确规定的，开发商若不按规定建设停车位，其规划设计方案就不会得到批准。也就是说，规划部门要求开发商建设停车位的目的，就是保证住宅小区内的居民车辆有地方停放，再直接一点说，这些停车位是供住宅小区内的居民使用的。可见，住宅小区停车位具有规划性和专用性。即使开发商作为所有权人时，也无权因小区业主暂时无力购买或不需购买停车位而擅自将多余车位对外出售。
