本罪侵犯的客体是国家对固体废物污染环境的防治制度。根据《固体废物污染环境防治法》的规定，国家对禁止进口不能作原料的废物；限制进口可以用作原料的固体废物。国务院环境保护主管部门会同国务院对外经济贸易主管部门制定、调整并公布可以用作原料进口的固体废物的目录，未列入该目录的固体废物禁止进口。确有必要进口列入上述规定目录中的固体废物用作原料的，须经国务院环境保护行政主管部门会同国务院对外经济贸易主管部门审查许可，方可进口。

本罪在客观方面表现为未以国务院有关主管部门许可，擅自进口固体废物用作原料，造成重大环境污染事故，致使公私财产遭受重大损失或者严重人体健康的行为。

本罪的主体为一般主体，即凡是达到刑事责任年龄具有刑事责任能力的人，均可构成本罪。单位也可构成本罪。

本罪在主观方面表现为过失。也就是说行为人对造成的严重危害后果主观是过失的，但是，对于未经国务院有关部门许可，擅自进口固体废物用作原料是法律禁止的，行为人则是明知的。
