1、犯罪主体

根据刑法规定，公司、企业、事业单位、机关、团体实施犯罪的，构成单位犯罪，因此，单位也可以成为犯罪主体。

2、犯罪的主观方面

是指犯罪主体对其实施的犯罪行为及其结果所具有的心理状态。犯罪主观方面的心理状态有两种，即故意和过失。

3、犯罪的客观方面

是指犯罪行为的具体表现。比如犯诈骗罪，犯罪人具有虚构事实、欺骗他人的行为，贩毒罪具有贩卖毒品的行为，等等。

4、犯罪客体

是指刑法所保护而被犯罪行为所侵害的社会关系。犯罪客体和犯罪对象是不同的，犯罪对象是犯罪行为所直接针对的对象，如杀人罪、伤害罪，犯罪对象是具体的被害人，而犯罪客体是指刑法所保护的公民人身权利不受非法侵害的这种社会关系。

1. Criminal subject

According to the provisions of the Criminal Law, a company, enterprise, public institution, organ or group that commits a crime constitutes a unit crime. Therefore, a unit can also become the subject of the crime.

2. Subjective aspects of crime

It refers to the psychological state of the criminal subject with regard to the criminal act and its result. There are two kinds of subjective psychological states of crime, namely, intention and negligence.

3. Objective aspects of crime

It refers to the specific performance of criminal acts. For example, for the crime of fraud, the criminal has the behavior of fabricating facts and deceiving others, and the crime of drug trafficking has the behavior of drug trafficking, and so on.

4. Criminal object

It refers to the social relations protected by criminal law and infringed by criminal acts. The object of crime and the object of crime are different. The object of crime is the object directly targeted by the criminal act, such as homicide and injury crime. The object of crime is the specific victim, while the object of crime refers to the social relationship that the personal rights of citizens protected by the criminal law are not violated illegally.
