美国法律里面指控是什么意思？

意思是指犯罪嫌疑人（criminal suspect）进入刑事司法体系。该阶段相当于我国刑事诉讼中的侦查阶段（investigation stage）。在有些国家和地区，采取检警一体化（an integrated operation model）的模式，即检察机关（公诉机关）监督/指挥警察开展侦查活动（如德国和台湾地区）；有些国家采用检警分立模式（如美国、中国）（a separated operation model），警察机关和检察机关的职能相对独立。

在我国，检察机关对公安机关的监督限于批准警察的逮捕申请（“批捕”）和审查**期间对案卷的审查（review）：审查中如果发现公安机关提供的证据不充分，可以退回警察机关补充侦查（return the case to the police for more investigation）。

在美国，拘留证（arrest warrant）是由**签发的；拘留之后两三天，要到**（initial appearance），由法官决定先放回去（保释），还是继续关押（remand，还押）。在中国，拘留证由公安机关直接签发；拘留之后三天（最多30天），公安机关要请检察院决定是先放回去，还是继续关押（法律上叫“逮捕”）。在美国，**从拘留就开始介入；在中国，**直到审判阶段才介入。
